To: All persons whose PHI was potentially impacted in the cybersecurity incident involving IGG’s computer network on October 22, 2021 whose address on file with IGG is in California, and who were the subject of the Notice of Data Breach that IGG published on April 22, 2022 (the “Settlement California Subclass”).

PLEASE READ THE NOTICE CAREFULLY

  • A Settlement has been reached with Illinois Gastroenterology Group P.L.L.C. (the “Defendant” or “IGG”) in lawsuits related to a cybersecurity disruption involving IGG’s computer network on October 22, 2021 (the “Data Breach”).
  • On November 18, 2021, an investigation conducted by IGG determined that an unauthorized third-party cybercriminal gained access to IGG’s systems, and that information contained in those systems for approximately 227,943 individuals may have been compromised by the third-party threat actor in the Data Breach. Settlement Class Members’ PII, PHI, and PBI, including names, addresses, dates of birth, Social Security numbers, driver’s licenses, passports, financial account information, payment card information, employer-assigned identification numbers, medical information, and biometric information, may have been compromised in the Data Breach.
  • On April 22, 2022, IGG published a Notice of Data Breach. Following notice of the Data Breach, the McNicholas v. Illinois Gastroenterology Group, Case No. 22 LA 173 (Ill. 19th Jud. Dist. Ct. Lake Cnty.) lawsuit was filed against IGG asserting claims arising from the Data Breach. In addition to the McNicholas lawsuit, several other lawsuits were filed against IGG asserting claims arising from the Data Breach.
  • IGG denies it has any liability for the claims asserted in the Lawsuits and contends that it did not engage in any improper conduct.

Settlement Class Members may file claims for (1) Tier 1 or Tier 2 Alternative Cash Payments, or (2) any combination of Documented Ordinary Losses, Documented Extraordinary Losses, and Credit Monitoring Services. All paper Claim Forms must be postmarked by June 16, 2023.

SUBMIT A CLAIM BY JUNE 16, 2023

You must submit a valid claim form to receive a payment or credit monitoring services from this Settlement.

DO NOTHING

You will receive no payment and will no longer be able to sue the IGG over the claims resolved in the Settlement.

EXCLUDE YOURSELF FROM THE SETTLEMENT BY MAY 17, 2023

You will receive no benefits, but you will retain your legal claims against the IGG.

OBJECT BY MAY 17, 2023

Write to the Court about why you do not like the Settlement. You must remain in the Settlement Class to object to the Settlement.

GO TO A HEARING ON JUNE 22, 2023

Ask to speak in Court about the fairness of the Settlement.

The Court must give final approval to the Settlement before it takes effect but has not yet done so. No payments or Settlement benefits will be issued until after the court gives final approval and any appeals are resolved.
